SCHOOL DISTRICTS SPORTS-INJURY RELEASE FORM OK, SAYS JUDGE

http://www.carpaltunnel-cure.com The Seattle School District’s sports-injury release form represents “a reasonable compromise,” said King County Superior Court Judge Donald Haley in a ruling yesterday. Judge Haley allowed the continued use of the form, saying the athletic program was not part of basic eduation, it is a volunteer endeavor, and the form is a reasonable response to the high insurance costs of operating the sports programs. He said the release “conforms to public policy . . . and does not violate due process. ” Their suit against the district, filed in 1984, charged that they were forfeiting their legal rights by signing the form Carpal Tunnel Exercises. The Vullietts said the form insulated the district against any possible negligence relating to a catastrophic injury and forces the injured athletes to give up their right to sue if they believe they were hurt through someone’s negligence.
